Biden’s new income-driven repayment plan faces another legal challenge

Missouri leads seven Republican states in lawsuit against Biden’s income-driven repayment plan, SAVE, arguing lack of authority. Second state-led action against SAVE in a month. Supreme Court previously rejected Biden’s broad student debt relief plan. SAVE forgives loans for those owing $12,000 or less after decade of payments, exempts those earning less than 225% of federal poverty line. Plaintiffs allege Biden bypasses checks and balances, liken SAVE to unauthorized grant program. Education Department cites 1993 congressional edict for authority. Missouri argues SAVE harms state loan servicer, MOHELA, by accelerating forgiveness timeline. Similar lawsuit filed by eleven states in March.
